Welcome to Whataloop ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our CRM platform, WhatsApp Business integration services, and related websites, applications, and services (collectively, the "Services").

Acceptance of Terms

By creating an account, accessing, or using Whataloop, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal authority to enter into these Terms
  • Not be prohibited from using the Services under applicable laws
  • Have a valid business registration (for business accounts)

Description of Services

Whataloop provides a Customer Relationship Management (CRM) platform with WhatsApp Business API integration that enables businesses to:

WhatsApp Messaging

Send and receive messages via WhatsApp Business API

Lead Management

Track and manage customer leads and contacts

Message Templates

Create and manage WhatsApp message templates

Analytics

View messaging analytics and delivery reports

Account Registration

Account Security

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

Important: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

WhatsApp Business Integration

By connecting your WhatsApp Business Account (WABA) to Whataloop, you agree to:

Compliance Requirements

Prohibited Uses

You may NOT use our WhatsApp integration for:

  • Sending spam or unsolicited bulk messages
  • Harassment, threats, or abusive communication
  • Fraudulent schemes or deceptive practices
  • Distributing malware or phishing content
  • Selling illegal products or services
  • Violating any applicable laws or regulations

User Responsibilities

As a user of Whataloop, you are responsible for:

Subscription and Payments

Billing Terms

  • Subscription Plans: Access to certain features requires a paid subscription
  • Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Price Changes: We may modify pricing with 30 days advance notice
  • Payment Processing: Payments are processed securely through Stripe

Refund Policy

Refunds may be provided at our discretion. Generally:

  • Refund requests must be made within 7 days of purchase
  • No refunds for partially used subscription periods
  • No refunds for accounts terminated due to Terms violations

Intellectual Property

Our Rights

Whataloop and its licensors retain all rights, title, and interest in:

  • The Whataloop platform, software, and technology
  • Our trademarks, logos, and brand elements
  • All documentation, content, and materials we provide

Your Rights

You retain ownership of:

  • Your customer data and contact lists
  • Content you create (message templates, etc.)
  • Your business information and branding

Limitation of Liability

To the maximum extent permitted by law:

  • Whataloop is provided "AS IS" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
  • We are not responsible for third-party services, including Meta/WhatsApp API availability

Third-Party Services: WhatsApp and Meta services are subject to their own terms and availability. We cannot guarantee their uptime or performance.

Indemnification

You agree to indemnify and hold harmless Whataloop, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content or data you submit through the Services
  • Your violation of any applicable laws or regulations

Termination

By You

You may terminate your account at any time by:

  • Cancelling your subscription through account settings
  • Contacting our support team at hello@whataloop.com

By Us

We may suspend or terminate your account if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Fail to pay subscription fees
  • Abuse the platform or other users

Effect of Termination

Upon termination:

  • Your access to the Services will be discontinued
  • Your data will be retained for 30 days, then permanently deleted
  • You may request a data export before termination
  • Outstanding fees remain payable

Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or in-app notification.

Continued use after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Punjab, India.
